Introduction
TG Tracking LLC (“TG Tracking,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, share, and safeguard your personal information when you use our websites, hardware devices, and cloud-based tracking services. We adhere to applicable privacy laws in the United States (including Wyoming state law and federal law), as well as international regulations like the EU General Data Protection Regulation (GDPR) and California Consumer Privacy Act (CCPA). Our services involve GPS tracking hardware and software used globally (including in the US, UK, and South Africa), so we handle personal data in compliance with relevant data protection standards worldwide. By using TG Tracking products or services, you agree to the collection and use of your information as described in this Policy.
Information We Collect
We collect various types of information to provide and improve our GPS tracking solutions:
- Account and Contact Information: When you register or subscribe, we collect personal identifiers such as your name, business name, email address, phone number, shipping/billing address, and account login credentials. This information is used to create your account, process payments, and communicate with you about your orders or service. Providing this data is often necessary to enter into our service contract with you.
- Device and Location Data: Our GPS trackers, sensors, and AI dashcams collect location-based information including GPS coordinates, date/time stamps, speed, direction, and other telemetry data (e.g. accelerometer or engine diagnostics). Because this data can identify or relate to an individual or their vehicle, it is treated as personal data. For example, our telematics devices periodically transmit their GPS location and related metrics to our cloud platform. We use and store this location and sensor data to enable real-time tracking, route history, driver scoring, and alert features of our service.
- Usage and Log Data: We automatically collect technical information when you interact with our website or apps. This includes IP address, browser type, device type and identifiers, operating system, mobile network information, pages or screens viewed, and timestamps of access. We may also record log-in attempts and usage events (such as clicks and setting changes) to monitor service performance and security. In addition, we use cookies and similar tracking technologies (see our Cookie Policy) to remember your preferences and analyze site usage.
- Payment Information: If you make purchases or subscribe to our services, our third-party payment processors (e.g. Stripe for US/UK/EU payments and PayFast for South Africa) collect your payment card details and billing information. We do not store full credit card numbers on our systems; such financial data is handled securely by the payment providers according to their privacy policies. We maintain records of your transactions, subscription plan, and payment history for account administration and financial reporting.
- Third-Party Data (if applicable): We may receive personal data about you from authorized third parties – for example, if you integrate TG Tracking with a third-party platform or if an employer or fleet operator provides information about you as an authorized user or driver. In such cases, we ensure the third party has a lawful basis to share your data and we treat it in accordance with this Policy.
We do not knowingly collect personal information from children under 16 years of age. Our services are intended for adult use only; if you are under 16, you may not create an account or use the services. We do not knowingly track or target minors, and if we learn that we have inadvertently collected a minor’s data, we will delete it.
How We Use Your Information
TG Tracking uses the collected information for the following purposes:
- Providing and Improving Services: We process your personal and device data to deliver our tracking and monitoring services. This includes using GPS and telemetry data to display asset locations on maps, generate trip reports, send alerts (like geofence breaches or speeding), and compute driver safety scores. We also use data to maintain and enhance the functionality of our cloud software and mobile apps, troubleshoot issues, and develop new features.
- Account Management and Support: Contact and account information is used to set up and manage your user account, authenticate you upon login, and provide you with customer support. We use your email or phone to send service-related communications, such as subscription confirmations, important system notifications, password resets, or responses to inquiries you send us.
- Payments and Subscription Management: We use payment and contact information to process your orders, subscription renewals, and any applicable fees. For example, if you are on a monthly or annual subscription, we will use stored payment details to bill your subscription at the agreed intervals, until you cancel.
- Communication and Marketing (with consent): With your permission or as permitted by law, we may send you newsletters, product updates, special offers or promotions related to our tracking solutions. You can opt out of marketing emails at any time by using the unsubscribe link or contacting us. We do not sell your personal information to third-party marketers, and we will only send third-party marketing communications with your explicit consent where required.
- Analytics and Research: We may aggregate and anonymize usage data (for example, average fleet speeds or general location trends) to understand how our services are used and to improve our offerings. Internally, we analyze telemetry and log data to monitor system performance, improve GPS accuracy, enhance user experience, and develop new analytics features.
- Legal Compliance and Security: We may use personal information as necessary to enforce our Terms and defend legal claims, to monitor for fraudulent or unauthorized activities (such as unauthorized tracking or SIM tampering), and to comply with applicable laws or law enforcement requests. If required by law or court order, we may process and share data to the extent necessary (see How We Share Information below).
We will not use your personal data for purposes other than those outlined above without notifying you and obtaining appropriate consent when required.
How We Share Information
We understand the importance of keeping your personal information private. We do not share, rent, or sell your personal data to unaffiliated third parties for their own marketing use. However, we do share information in the following contexts, as necessary for our operations and as permitted by law:
- Service Providers: We employ trusted third-party companies to perform tasks on our behalf, such as payment processing, cloud hosting, data storage, map services, email delivery, and customer support tools. These providers only receive the information needed to deliver their specific services (for example, our cloud infrastructure providers store our databases that contain your account and tracking data). They are contractually obligated to handle your data securely and only for our specified purposes.
- Telecommunications and Network Partners: Our devices communicate via global cellular networks (e.g. 4G/LTE-M) and LoRaWAN networks. In order to transmit data (like sending your device’s GPS coordinates to our servers), certain data (such as the device’s SIM card number, IMEI, and the data payload) passes through network operators. We share the minimal necessary information with these network partners to activate devices on their networks and ensure connectivity. These partners may process data for connectivity and billing, but they do not use your personal data for other purposes.
- Affiliates and Regional Partners: If TG Tracking is working with a local distributor, subsidiary, or integration partner in your region (for example, a partner in the UK or South Africa assisting with your deployment), we may share relevant information with them to support your account and services. Any such partners are bound to protect your data and use it consistent with this Policy.
- Business Transfers: If we undergo a business transaction such as a merger, acquisition, corporate reorganization, or sale of assets, your information may be transferred as part of that deal. We would ensure the acquiring party is bound to respect your personal data in a manner consistent with this Privacy Policy. You would be notified via email and/or a prominent notice on our website of any change in ownership or uses of your personal information.
- Legal Requirements: We may disclose personal information if required to do so by law or in response to valid requests by public authorities (e.g., a court order, subpoena, or government demand). We may also share information when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud or abuse (such as unlawful tracking activities), or respond to a government request. For example, if law enforcement provides the necessary legal documentation, we might be compelled to provide location data for an investigation.
- With Your Consent: In situations where you explicitly consent to or request data sharing, we will share your information accordingly. For instance, if you use a feature that allows data export or integration with a third-party application, we will share data at your direction. You have the right to withdraw consent for such sharing at any time.
When we share data with any third party, we require that they handle it with appropriate confidentiality and security measures. We do not allow our service providers to use your data for their own marketing or other purposes not related to providing the services we’ve requested.
Data Retention and Storage
We retain personal data only as long as necessary to fulfill the purposes for which it was collected, including for any legal, accounting, or reporting requirements. Unless a longer retention period is required by law, we will generally store your personal information (including account info, and tracking data) for up to five (5) years from its collection or from your last active use of our services. For example, location history and telematics records may be stored for up to 5 years to allow long-term reporting and analysis for our customers. After this period, or upon your verified request, we will either securely delete or anonymize your data, unless we are legally required to keep it longer.
Some data may be retained for shorter periods:
- Web server logs and security logs may be kept for a few months for security analysis.
- If you cancel your subscription or delete your account, we will remove or anonymize personal data associated with your account within a reasonable time after closure (except to the extent we need to keep it for legal obligations or dispute resolution).
- We may retain aggregated, non-identifiable data (for example, overall system usage statistics) indefinitely for analysis, but this data will not identify any individual.
Please note that if you have provided information to other users via our platform (for example, if you are in a fleet and share a location or message), those users may retain that information. We encourage you to use caution when sharing personal data in any interactive areas of our services.
International Data Transfers
Given the global nature of our operations, the personal data we collect may be transferred to and stored on servers in countries other than your own. Primarily, data will be stored in cloud servers which may be located in the United States. If you are located outside the U.S., be aware that we will ensure appropriate safeguards when transferring your data internationally. For example, for data originating from the European Economic Area (EEA) or UK, we rely on mechanisms such as Standard Contractual Clauses or other legally approved transfer frameworks to ensure an adequate level of protection for your personal information. We also comply with South Africa’s Protection of Personal Information Act (POPIA) for data from South African users, and other relevant laws in jurisdictions where we operate. By using our services, you acknowledge that your personal data may be transferred to our facilities and those third parties with whom we share it as described in this Policy, which could be in countries with different data protection laws than your country of residence.
Regardless of where your data is processed, we take steps to ensure that your privacy rights continue to be protected. All transfers of personal data are done in compliance with applicable privacy laws and with contractual protections in place.
Your Rights and Choices
You have rights regarding your personal information, and TG Tracking is committed to honoring them:
- Access and Portability: You have the right to request a copy of the personal data we hold about you, and to obtain it in a commonly used electronic format. This helps you to verify the information and to transfer it to another service if needed (data portability).
- Correction: If any of your personal information is inaccurate or incomplete, you have the right to request correction or update of that data. You can update some information by logging into your account settings, or by contacting us for assistance.
- Deletion: You have the right to request deletion (erasure) of your personal data when it is no longer needed for the purposes for which it was collected, or when you withdraw consent (where applicable). Upon a valid deletion request, we will erase your data unless an exemption applies (for example, we may retain data if required for legal obligations or if it is in active use for providing you a service you still have).
- Objection and Restriction: You may have the right to object to certain processing of your data, such as processing based on our legitimate interests or for direct marketing. You can also request that we restrict processing of your data (i.e., keep it but not use it) in certain circumstances – for example, while we address a claim that the data is inaccurate or being processed unlawfully.
- Withdraw Consent: If we rely on your consent to process any personal data (such as for marketing emails or certain types of sensitive data), you have the right to withdraw that consent at any time. This will not affect the lawfulness of processing based on consent before its withdrawal. For instance, you can opt out of marketing communications by clicking “unsubscribe” in any email or contacting us.
- California Privacy Rights: If you are a California resident, the CCPA provides you the right to know what personal information we collect, use, and disclose about you, and the right to request that we delete personal information (with similar exceptions for necessary business or legal purposes). You also have the right to opt out of the “sale” of your personal information. However, TG Tracking does not sell personal information in the traditional sense. We also will not discriminate against you for exercising any CCPA rights. California users can exercise their rights by contacting us as described below.
- Other Jurisdictions: Users in some jurisdictions (e.g., the EU/UK, South Africa) have the right to lodge a complaint with a data protection authority if they believe we have infringed their privacy rights. For example, EU users can contact their country’s supervisory authority; South African users can contact the Information Regulator. We encourage you to contact us first so we can address your concerns directly.
To exercise any of your rights, please contact us at [email protected]. You may be required to provide information to verify your identity (such as confirming control of your email address or other account details) before we fulfill your request. We will respond to valid requests within the timeframe required by law (generally within 30 days). Note that some rights may be subject to legal exceptions; if we cannot comply with a specific request, we will provide an explanation.
Data Security
We take the security of your personal data very seriously. TG Tracking implements appropriate technical and organizational measures to protect your information from unauthorized access, alteration, disclosure, or destruction. These measures include, but are not limited to:
- Encryption of data in transit (e.g., using HTTPS/TLS for our website and apps, and secure protocols for device communications) and, where applicable, at rest.
- Secure cloud storage with firewalls and access controls to limit access to data only to personnel and service providers who need it for their duties.
- Regular security testing and vulnerability assessments of our systems and infrastructure.
- Anonymization or pseudonymization of data where feasible, especially for development and analytics uses.
- Internal policies and training for our employees on data privacy and security, including strict confidentiality obligations.
Despite our efforts, no method of transmission over the Internet or method of electronic storage is 100% secure, so we cannot guarantee absolute security. Users are responsible for keeping their account credentials secure and not sharing passwords with others. If you have reason to believe that your interaction with us is no longer secure (for example, if you suspect your account has been compromised), please immediately notify us using the contact information below.
