Acceptable Use Policy

Introduction

This Acceptable Use Policy (“AUP”) outlines the rules and guidelines for using TG Tracking’s devices, SIM cards, software applications, and network services (collectively, “the Services”). All users and customers of TG Tracking must comply with this AUP as a condition of using our Services. The purpose of this policy is to ensure our Services are used safely, lawfully, and in a manner that respects the rights of others and the integrity of our systems. Violating this AUP may lead to suspension or termination of your service, legal action, or other consequences as appropriate.

By using TG Tracking hardware or services, you agree to abide by the following rules:

Prohibited Uses

1. Unlawful Tracking and Privacy Violations:
You may not use TG Tracking devices or platform to track the location or movement of any person, vehicle, or asset without proper authorization or consent. This means:

  • You should only install our GPS trackers on vehicles or property that you own, lease, or have the legal right to monitor. Installing a tracker on someone else’s car or property without permission is typically illegal under privacy and stalking laws.
  • If you are an employer using TG Tracking to monitor company vehicles or employee driving activity, ensure you comply with employment laws and privacy regulations (e.g., informing employees of the monitoring if required, and not tracking outside of work scope or hours where not allowed).
  • Do not use our Services for any form of stalking, harassment, or surveillance that violates a person’s reasonable expectation of privacy or any restraining orders or legal protections.
  • You are responsible for understanding and following any local laws that might apply to GPS tracking in your jurisdiction. TG Tracking is not liable for how you choose to use the devices; we strictly prohibit unlawful use.

2. Tampering with Devices or SIMs:
Our devices often come with pre-configured SIM cards and are certified to operate on specific networks. You must not:

  • Open the device casing to alter hardware components, or attempt to modify the device’s firmware in an unauthorized way. Such tampering could not only void your warranty but also cause the device to malfunction or violate communication regulations.
  • Remove, replace, or misuse the provided SIM card. The SIM in each device is tied to our service plans. Putting it into other devices or using a third-party SIM in our tracker to use our software is not allowed and may result in additional fees or service termination. Similarly, using our SIM card in another device (especially to consume data outside our platform) is a breach of this AUP.
  • Use the Service in ways intended to circumvent usage limits or billing. For example, deliberately sending false location pings or using hardware tricks to avoid data charges is prohibited.
  • Engage in “SIM boxing” or similar practices where our SIM cards are used in contravention of carrier policies (e.g., using in call/SMS gateways). Our services are for telematics data only as configured.

3. Network and Service Integrity:
We maintain a robust cloud platform and network services. You must not:

  • Attempt to gain unauthorized access to any part of our systems, accounts that are not yours, or to restricted data. This includes trying to log into servers or devices you are not permitted to access, or exploring network vulnerabilities beyond your own assets.
  • Probe, scan, or test the vulnerability of our infrastructure or networks without official authorization (penetration testing your own account within normal usage is fine, but anything that could affect others or our backend is not).
  • Launch any form of attack or interference, such as Denial of Service (DoS) or distributing viruses or malware through our platform. For instance, you should not write a script to overwhelm our API with requests beyond reasonable usage.
  • Interfere with or disrupt the proper functioning of our Services, including any servers or networks connected to the Service. You must not deploy any automated systems (bots, scrapers) that excessively burden our platform beyond what would be considered normal for a single user or fleet account.
  • Modify or obscure headers or identification information in data packets when using the Service (no spoofing of device IDs, IP addresses, etc., to mask your usage or identity in an improper way).

4. Misuse of the Platform and Data:

  • No Spam or Unauthorized Messaging: Our platform might allow sending notifications or messages (for example, SMS or email alerts). These features should be used strictly for their intended purpose (alerts to yourself or authorized personnel about tracking events). You must not use the Service to send unsolicited commercial messages or “spam” to unrelated third parties.
  • Accuracy of Information: When registering and using our Service, provide accurate information. Do not attempt to mislead TG Tracking with false identities, documents, or credit information. Also, do not input fraudulent data into the platform (for example, don’t purposely tag a device with someone else’s identity or license plate to impersonate tracking them).
  • No Illegal Content: Do not upload, generate, or store through our Services any content that is illegal, harmful, or violates the rights of others. While our service isn’t a content platform (it’s mostly location data and some notes), an example would be using device camera features (if applicable) to capture and store illicit images, or using notes/labels in the system to store defamatory or hate content.
  • Compliance with Laws: If you use exported data from TG Tracking (like downloading reports, or integrating via API into other systems), you are responsible for ensuring that use complies with applicable data protection laws, especially if the data includes personal information (like driver identities, etc.). For instance, exporting location history of drivers might require certain notices or consents under GDPR if in Europe; you must handle exported data lawfully.

5. Safety and Tampering:

  • Installation Safety: Follow our guidelines for installing devices (especially in vehicles). Don’t install devices in a way that interferes with vehicle controls, airbags, or safety systems. Do not dangerously drive or operate equipment while interacting with tracking devices or the mobile app (e.g., no texting/looking at the app while driving; use a passenger or park safely first).
  • No Signal Jamming: You must not use any jammer or device intended to interfere with GPS signals or cellular signals of our trackers. Using such equipment is illegal in many places and is against our policy. Similarly, do not intentionally shield or encapsulate our device to defeat its purpose if you expect service (if you need to pause tracking, simply power it down or remove it as appropriate rather than malicious interference).

6. Fair Use:

  • Our unlimited or fixed-fee service plans (if any) assume normal usage patterns. If you have a special use case that might generate extraordinarily high data usage (like streaming video continuously on an AI dashcam beyond typical needs), talk to us to ensure it’s within plan limits. Using an “all-you-can-use” plan for something clearly beyond typical vehicular tracking usage may breach fair use and we may throttle or charge for excessive usage after warning.
  • Do not resell or provide our tracking services as a service bureau to third parties unless authorized. For example, you cannot just buy our devices on one plan and then offer tracking-as-a-service to multiple external clients without a proper agreement or reseller arrangement. If you are interested in reselling, contact us for a partner program.

Enforcement and Consequences

We reserve the right to investigate any suspected violations of this AUP. This may include gathering information from the user or account involved and the complaining party (if any), and reviewing logs or other data. We may, at our discretion and without notice, remove or disable access to content or suspend your use of the Services if we believe you have violated this AUP or applicable law.

In particular:

  • If we detect a device on our network that is violating rules (for example, a SIM being moved to an unauthorized device, or unusual traffic patterns indicating misuse), we may remotely suspend that device’s connectivity pending investigation.
  • For minor or first-time violations, we will attempt to warn you and work with you to correct the issue.
  • Repeated or egregious violations (like deliberate unlawful tracking, system hacking attempts, or criminal activity) will result in immediate termination of your account and possibly reporting to law enforcement. You may also forfeit fees paid in such cases per our Terms of Service.
  • TG Tracking will cooperate with law enforcement or court orders requesting or directing us to disclose the identity of users engaged in unlawful behavior. Where allowed, we will notify users of such requests.

You are responsible for any costs or losses incurred by TG Tracking (including our affiliates and partners) as a result of your breach of this AUP. This includes our right to seek reimbursement for any data, network, or legal expenses incurred due to your misuse (for instance, if SIM tampering led to huge carrier charges or if we incur costs responding to a lawsuit because of your unlawful tracking, you may be held liable).

Examples of Acceptable Use

To clarify, here are some examples of acceptable uses of TG Tracking Services, which are encouraged and within policy:

  • Installing a TG tracker in your personal car, motorcycle, boat, or ATV to monitor its location and have theft-recovery measures, all fully owned by you (or in family vehicles with consent of those family members).
  • A business equipping its fleet of delivery vans with TG trackers and dashcams to optimize routes, monitor driver safety (with a company policy informing drivers of the devices), and using our platform data to coach employees and secure assets.
  • Using our sensors on equipment (like generators or containers) that you rent out, where the rental agreement with your customer clearly states a tracker is attached and you will monitor for location/security.
  • Integrating TG Tracking API into your company’s logistics software to get real-time updates of where your assets are, as long as the data is used internally and lawfully.
  • Temporarily disabling a device (via our software) when you hand over a vehicle for personal use to someone to respect privacy, if that’s a compliance need, rather than secretly tracking when not allowed.

Policy Changes

This Acceptable Use Policy may be updated by TG Tracking from time to time, especially as technology or legal requirements evolve. We will post any changes on our website and/or notify active customers via email or in-app notification. It’s your responsibility to review and comply with the current AUP. Continued use of the Services after an update signifies acceptance of the revised terms.

Questions and Reporting

If you are unsure whether any contemplated use or action might violate this AUP, please contact us to clarify. We would be happy to advise on compliance. Also, if you become aware of any violation of this AUP by any TG Tracking customer or user, please report it immediately to us at [email protected]. Provide as much detail as possible, including links, device IDs, or descriptions of the misconduct, so we can investigate properly.

By using our Services, you affirm that you will use them only for lawful and authorized purposes and in compliance with this AUP. Thank you for helping us maintain a safe and trustworthy service for all users.
